This proposed code modification is required to ensure compliance with EC Regulation 715/2009 (the Regulation), amended by the European Commission Decision of 24 August 2012. CMP is required to address the issue of contractual congestion at Interconnection Points where shippers cannot gain access to capacity notwithstanding the physical availability of such capacity. CMP mechanisms aim to maximise the capacity which is available to shippers and bring unused capacity back to the market to be resold through regular capacity booking procedures.

This proposal is being made to facilitate the transition of the Northern Irish Gas transmission system from a point-to-point regime. This proposal will introduce a new section of the BGE(NI) Code, the ‘Transition Document’ which will contain the procedures which will apply from the Implementation Date (proposed as 1st January 2015) until the Transition Date (1st October 2015) and set out how existing entitlements of capacity will be treated after the Transition Date. This change will ensure that Entry Capacity is introduced into the Northern Irish regime in time to enable a coordinated approach to pipeline access (including bundling of capacity at Interconnection Points) with the upstream transporters as is required by the CAM Regulation (EU 984/2013).

This proposal is being made to implement the requirements of the Capacity Allocation Mechanisms (CAM) Regulation (EU 984/2013). The proposal introduces two new Sections of the Code (replacing the existing Section 1) to cover Entry Capacity (Section 1A) and Exit Capacity (Section 1B), and contains amendments to further sections. This change will ensure that Entry Capacity is introduced into the Northern Irish regime in time to enable a coordinated approach to pipeline access (including bundling of capacity at Interconnection Points) with the upstream transporters as is required by the CAM Regulation (EU 984/2013).

This proposal is being made to implement the requirements of the Capacity Allocation Mechanisms (CAM) Regulation (EU 984/2013) which defines the gas day as operating from 05:00 to 05:00 the following day. The proposal amends the text of the GNI (UK) Limited, code to account for the change and provides for the transition on 30th September 2015 to the new gas day definition.

This proposal is being made to address Nominations arrangements as a result of the implementation of EU Codes and the transition of the Northern Irish transportation regime to an entry-exit model. It introduces arrangements for Shippers to make entry nominations independently of exit nominations, and the procedures by which nominations (and renominations) at an interconnection point will be matched with upstream nominations and confirmed by the TSOs. It also aligns the timing for submission of exit nominations with those for entry, and introduces trade nominations, which are to enable Shippers to trade gas with one another at the Northern Irish Balancing Point.

This proposal is being made to address Allocations arrangements as a result of the implementation of EU Codes. It provides for the replacement of the Moffat Agent allocations role with an ‘allocate as nominate’ regime at Moffat, as a result of the implementation of an Operational Balancing Agreement at the point. It also describes the processes by which Shippers will receive Trade Allocations. The Modification also incorporates the existing rules for allocations at Exit Points into a single Code section with the new elements and provides for the calculation of aggregate allocations which will enable the calculation of an aggregate imbalance position for each Shipper on the Northern Ireland network as a whole. Supporting changes to section 9 are also included.

This proposal is being made to address Invoicing and Credit arrangements as a result of the implementation of EU Codes. It provides for the invoicing for new capacity products, (the charges for which are determined in accordance with the Licence) and the removal of the old ‘STC/VRF/BB’ invoice which is no longer required. Under the entry-exit model, Shippers will have a single imbalance position which is to be calculated across the whole of the Northern Ireland network. It has been agreed that Premier Transmission shall invoice for PS Code Charges (which include Imbalance Charges and Scheduling Charges) and manage the Northern Ireland Disbursement Account on behalf of all the Northern Ireland TSOs and Shippers. This Modification Proposal therefore clarifies these revised arrangements.

The Modification Proposal updates the credit arrangements to cover the new IP Capacity products, clarifying some process steps and in particular addressing the determination and placement of credit in relation to Short Term Capacity Products and, where necessary, credit for Traders (who do not hold any capacity). It also provides some amendments to the Credit Committee Terms of Reference to reflect the requirements arising from the introduction of Capacity Auctions.

This proposal is being made to revise Section 6 (Exceptional Events and Emergencies) of the GNI(UK) Code, to take account of the introduction of the entry-exit model in Northern Ireland, and, in particular, introducing the term ‘exceptional event’, which is required under the EU Interoperability Code.

This proposal is being made to revise the Congestion Management Procedures in the Northern Ireland regime to reflect the introduction of an entry-exit transmission model. Congestion Management Procedures are required at Interconnection Points (IP) by Annex 1 of EU Regulation 715/2009, and were previously introduced into the point-to-point Northern Ireland regime. This proposal is to revise the procedures to reflect the move to entry-exit, and in particular to ensure that that the procedures operate independently at each IP and independently of similar pre-existing arrangements at exit points.

This proposal is being made to incorporate references to the new WTL Transmission Code as well as to make ‘housekeeping changes’ in the GNI (UK) Code following the implementation of the series of Modifications made during 2015 for the purposes of compliance with EU legislation. In addition, it includes four areas of more significant change intended to update the Code and aid clarity.
